1. Introduction
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Corbie ("we," "us," or "our") regarding your access to and use of the Volume App mobile application (the "App").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
2. Subscription Terms
- 2.1 Monthly Subscription: The Pro version of the App is offered as an auto-renewing monthly subscription. You will be charged the stated monthly fee (plus any applicable taxes) at the beginning of your subscription and every month thereafter.
- 2.2 Automatic Renewal: Your subscription will automatically renew each month unless you cancel it before the renewal date.
- 2.3 Cancellation: You may cancel your subscription at any time through the customer portal or by contacting support. Upon cancellation, you will continue to have access to Pro features until the end of your current billing period.
- 2.4 Refunds: Subscription fees are non-refundable. We do not provide refunds or credits for any partial subscription periods.
3. License and User Conduct
- 3.1 License Grant: We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with these Terms.
- 3.2 Prohibited Uses: You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
- Redistribute, sell, rent, loan, or sub-license the App or its features to third parties.
- Use the App for any illegal purpose or in violation of any local, state, national, or international law.
- Attempt to bypass the payment mechanism to access Pro features without payment (e.g., using "cracked" versions).
4. Termination and Suspension
- 4.1 Right to Terminate: We reserve the right to terminate or suspend your access to the App (or specific features within it) immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
- 4.2 Effect of Termination: Upon termination, your right to use the App will immediately cease. If we terminate your access due to a violation of Section 3 (e.g., piracy or tampering), you will not be entitled to a refund of your one-off payment.
5. Intellectual Property
The App, including its original content, features, code, and functionality (specifically the calculation algorithms and logic), are and will remain the exclusive property of Corbie. The App is protected by copyright and trademark laws of the United Kingdom and foreign countries.
6. Limitation of Liability
- 6.1 "As Is" Basis: The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the accuracy or reliability of the calculations.
- 6.2 Production Errors: You acknowledge that this App is a tool to assist in calculations. We are not liable for any financial losses, production delays, or errors resulting from the use of this App. It is the User's responsibility to verify all final calculations before committing to final construction or delivery.
- 6.3 Data Loss & Downtime: To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, loss of profits, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the App.
- Any bugs, viruses, or crashes that may be transmitted to or through our App.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
7.1 Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts located in England and Wales to resolve any legal matter arising from these Terms.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
